Rights over data of third parties and deceased people
How to object to processing or request erasure if you appear in the content, or if you are a relative.

This page is for those who did not create the avatar but are involved: people appearing in uploaded memories, and heirs/relatives of deceased people.
1. Who this page is for
- Living people whose data (photos, voice, messages) appears in content uploaded by another user.
- Relatives and heirs of a deceased person represented by an avatar, under Art. 2-terdecies of the Italian Privacy Code.
2. Which rights you can exercise
- Find out whether we process data concerning you.
- Request its rectification or erasure.
- Object to processing or request its restriction.
- In the case of a deceased person, request removal of the avatar or of specific content.
3. How to make a request
Write to hello@berightback.digital stating: who you are and your relationship to the data/the person concerned; a description of the content or avatar in question (if you know it); the right you intend to exercise.
We may ask for elements to verify your identity or entitlement, in line with the data minimisation principle. We will respond within the timeframe set by the GDPR (normally within one month).
4. Complaint to the authority
Your right to lodge a complaint with the Italian Data Protection Authority (Garante, www.garanteprivacy.it) always remains unaffected.
