Terms of Service

1. Who we are and what we offer

Be Right Back is a service provided by STARS SRL that lets you create AI-based conversational avatars, built from the memories (text, photos, audio, video, documents) you upload.

The service is currently in beta: some features may be incomplete, unstable or subject to change.

2. Nature of the service: it is an artificial intelligence

The service is in no way a substitute for psychological or medical support. If you are going through a difficult bereavement, we encourage you to also reach out to professionals or support services.

3. Account and requirements

To use the service you must be at least 18 years old and provide truthful information. You are responsible for the confidentiality of your credentials and for any activity carried out through your account.

4. Your representations about the content you upload

By uploading memories and creating an avatar, you represent and warrant that:

• you have the right to use those materials and to process their content;
• where the materials contain data or images of other living people, you have the necessary entitlement or consent, or a legitimate basis to process them;
• where the avatar represents a deceased person, you act as a relative or a person entitled under Art. 2-terdecies of the Italian Privacy Code;
• you do not use the service to impersonate living people without their consent, nor for defamatory, deceptive or unlawful purposes.

You agree to indemnify us against third-party claims arising from a breach of these representations.

5. Prohibited content

You may not upload unlawful content, content that infringes the rights of others, that represents living people without consent, or that aims to deceive third parties about the identity of a real person.

6. Ownership of content

The content you upload remains yours. You grant us a limited, non-exclusive licence necessary to provide the service (storage, processing, generating responses). We do not claim ownership of your memories.

7. Payments

Some features may be offered for a fee. Pricing, plans and refund terms will be indicated when payment is activated. During the beta, paid plans may not yet be active.

8. Limitation of liability

The service is provided "as is". To the extent permitted by law, we are not liable for the accuracy of AI-generated responses or for damages arising from misuse of the service. Nothing in these terms excludes liability that cannot be excluded by law (e.g. in case of wilful misconduct or gross negligence, or towards consumers).

9. Suspension and termination

You may close your account at any time. We may suspend or close accounts that breach these terms or the law, giving notice where possible.

10. Governing law and jurisdiction

These terms are governed by Italian law. For consumers, the mandatory jurisdiction of their place of residence or domicile applies.

11. Changes

We may update these terms. In case of material changes we will notify you; continued use of the service after notice constitutes acceptance.
